EU AI Act Compliance

At FactR Limited, we are dedicated to upholding the principles and requirements of the EU Artificial Intelligence (AI) Act. As part of our ongoing commitment to ethical and responsible AI development, we ensure compliance with the Act to safeguard user trust, safety, and transparency.

Risk Classification of AI Systems

In accordance with the EU AI Act, we categorize our AI systems based on their risk levels:

High Risk
AI systems with the potential to cause significant harm if they fail or are misused, which may cause serious risks to health, safety or fundamental rights.

Minimal Risk
AI systems with minimal risk are designed for general-purpose usage with no significant obligations under the Act.

Unacceptable Risk
AI systems considered a clear threat to the safety, livelihoods and rights of people are banned.


Limited risk
AI systems with a risk of manipulation or deceit, thereby requiring to comply with transparency requirements, such as informing users of their AI-driven nature.

Prohibited Practices Under The Act

We unequivocally oppose and avoid engaging in AI practices deemed unacceptable and prohibited under the EU AI Act. This includes any (unacceptable risk), AI systems that pose a clear threat to the safety, livelihoods, and fundamental rights of individuals, as such systems are explicitly banned by the Act.

Other prohibited practices under the EU AI Act, include but are not limited to:

  • Harmful AI-based manipulation and deception.

  • Harmful AI-based exploitation of vulnerabilities.

  • Social scoring.

  • Individual criminal offence risk assessment or prediction.

  • Untargeted scraping of the internet or CCTV material to create or expand facial recognition databases.

  • Emotion recognition in workplaces and education institutions.

  • Biometric categorization to deduce certain protected characteristics

  • Deploying AI systems that manipulate human behaviour or exploit vulnerabilities for harmful purposes.

  • Utilizing real-time biometric identification systems in public spaces, except in cases explicitly permitted by law.

Self-Identification of Compliance

FactR Limited has conducted a thorough self-assessment of our AI systems using the EU AI Act Compliance Checker provided at artificialintelligenceact.eu. This assessment confirms our compliance with the regulatory obligations outlined in the EU AI Act. (See our answers below for reference).

FactR Limited’s compliance status at this time is that we are excluded from the EU AI Act and do not face any obligations. Our product, DataPeak by FactR, is considered to be designed for general-purpose usage, falling into the minimal risk category.

Is my system an 'AI System' according to the EU AI Act?

An artificial intelligence system (AI system) is defined as: A machine-based system designed to operate with varying levels of autonomy and that may exhibit adaptiveness after deployment and that, for explicit or implicit objectives, infers, from the input it receives, how to generate outputs such as predictions, content, recommendations, or decisions that can influence physical or virtual environments.

General Purpose AI model: an AI model, including when trained with a large amount of data using self-supervision at scale, that displays significant generality and is capable to competently perform a wide range of distinct tasks regardless of the way the model is placed on the market and that can be integrated into a variety of downstream systems or applications.
